This article examines, through a theoretical lens, two issues concerning equality under international law thrown up by the ongoing Russo-Ukrainian War: the equal treatment of belligerents on different sides under international humanitarian law (IHL), which is being contested by revisionist just war theorists, and the unequal treatment of Ukrainians with different genders assigned at birth who are trying to flee Ukraine, which is being contested under international human rights law (IHRL). By examining different conceptions of equality through the lens of (...) social ontology, this article distinguishes between the regulatory focus of IHL on individual agency and the regulatory focus of IHRL on social structures, which directly influence how ‘difference’ and ‘sameness’ are recognized and determined for the purpose of conceptualizing equality. Because of IHL’s focus on individuals, whose agency is limited in war, only highly agential conduct (e.g. targeting civilians) makes a ‘difference’ under IHL. Meanwhile, outside IHL’s regulatory focus, the different causes of states’ participation in war are evened out as the ‘same’ structured positions occupied by different individuals, warranting their same treatment according to belligerent equality. On the other hand, because of IHRL’s focus on social structures, which heavily condition the individuals, structural arrangements make a ‘difference’ under IHRL. Outside IHRL’s regulatory focus, individuals’ different innate characteristics such as sexual characteristics are evened out as the ‘same’ agential quality of being human, warranting their same treatment according to sex equality. The article argues that the contestations about these equality principles find deeper roots in their divergent social ontological visions, the revelation of which can open up new spaces for dialogue on and inquiry into a common social world that grounds the legal conceptions of equality. In this paper, we describe four broad ‘meta-methods’ employed in scientific and philosophical research of qualia. These are the theory-centred metamethod, the property-centred meta-method, the argument-centred meta-method, and the event-centred meta-method. Broadly speaking, the theory-centred meta-method is interested in the role of qualia as some theoretical entities picked out by our folk psychological theories; the property-centred meta-method is interested in some metaphysical properties of qualia that we immediately observe through introspection ; the argument-centred meta-method is interested in the role of (...) qualia in some arguments for non-physicalism; the event-centred metamethod is interested in the role of qualia as some natural events whose nature is hidden and must be uncovered empirically. We will argue that the event-centred metamethod is the most promising route to a comprehensive scientific conception of qualia because of the flexibility of ontological and methodological assumptions it can provide. We also reveal the hidden influences of the different meta-methods and in doing so show why consideration of meta-methods has value for the study of consciousness. (shrink)

Russellian monism – an influential doctrine proposed by Russell (1927/1992) – is roughly the view that the natural sciences can only ever tell us about the causal, dispositional, and structural properties of physical entities and not about their categorical properties, and, moreover, that our qualia are constituted by categorical properties. Recently, Stoljar (2001a, 2001b), Strawson (2008), Montero (2010, 2015), Alter and Nagasawa (2012), and Chalmers (2015) have attempted to develop this doctrine into a version of physicalism. Russellian monism faces the (...) so-called combination problem, according to which it is difficult to see how categorical properties could collectively constitute qualia. In this paper, I suggest that there is an insufficiently discussed aspect of the combination problem which I call the difference-maker problem. Taking the difference-maker problem into account, I argue that the combination problem – whether or not it can be solved – results in a dilemma for the project of developing Russellian physicalism. That is, Russellian monism is either physicalistically unacceptable or it is implausible; hence, Russellian monism and physicalism are incompatible. (shrink)

Russellian monism—an influential doctrine proposed by Russell (The analysis of matter, Routledge, London, 1927/1992)—is roughly the view that physics can only ever tell us about the causal, dispositional, and structural properties of physical entities and not their categorical (or intrinsic) properties, whereas our qualia are constituted by those categorical properties. In this paper, I will discuss the relation between Russellian monism and a seminal paradox facing epiphenomenalism, the paradox of phenomenal judgment: if epiphenomenalism is true—qualia are causally inefficacious—then any judgment (...) concerning qualia, including epiphenomenalism itself, cannot be caused by qualia. For many writers, including Hawthorne (Philos Perspect 15:361–378, 2001), Smart (J Conscious Stud 11(2):41–50, 2004), and Braddon-Mitchell and Jackson (The philosophy of mind and cognition, Blackwell, Malden, 2007), Russellian monism faces the same paradox as epiphenomenalism does. I will assess Chalmers’s (The conscious mind: in search of a fundamental theory. Oxford University Press, New York, 1996) and Seager’s (in: Beckermann A, McLaughlin BP (eds) The Oxford handbook of philosophy of mind. Oxford University Press, New York, 2009) defences of Russellian monism against the paradox, and will put forward a novel argument against those defences. (shrink)

The disciplinary characterisation (DC) is the most popular approach to defining metaphysical naturalism and physicalism. It defines metaphysical naturalism with reference to scientific theories and defines physicalism with reference to physical theories, and suggests that every entity that exists is a posited entity of these theories. DC has been criticised for its inability to solve Hempel’s dilemma and a list of problems alike. In this paper, I propose and defend a novel version of DC that can be called a historical (...) paths approach. The idea is (roughly) that metaphysical naturalism can be defined with reference to the historical ideas that current scientific ideas descend from. I argue that it is not rendered implausible by the above problems, and hence that DC is more defensible and attractive than it may first appear. I then argue that the approach also provides a useful framework for the naturalisation of the philosophy of mind and phenomenology. (shrink)

Alexander Bird (2001; 2002; 2007) offers a powerful argument showing that, regardless of whether necessitarianism or contingentism about laws is true, salt necessarily dissolves in water. The argument is that the same laws of nature that are necessary for the constitution of salt necessitate the solubility of salt. This paper shows that Bird’s argument faces a serious objection if the possibility of emergentism – in particular, C. D. Broad’s account – is taken into account. The purpose of this article was to validate the published artificial intelligence facilities management outsourcing relationships system by real business cases in the working environment. The research aims to inspire the modern FM professionals in different industries with some challenging and innovative concepts about FM outsourcing relationships between facilities owners and service providers. First, it will briefly introduce the theory of the FM outsourcing relationships system on how it can help the FM seniors and strategists to design their FM daily (...) strategies wisely and make their business more effective and productive. Second, it will also introduce what the research is practically doing in the stage of case study for test and verification. It is concluded that FM outsourcing categorization may help to define the appropriate relationships. This further detailed outcome generated from the AI can be considered a solid reference to define and explain the existing outsourcing relationships between the stakeholders and the service providers to assign an outsourcing category to the FM relationship between the client and service provider based on the learnt rules. Monism is our name for a range of views according to which the connection between dispositions and their categorical bases is intimate and necessary, or on which there are no categorical bases at all. In contrast, Dualist views hold that the connection between dispositions and their categorical bases is distant and contingent. This paper is a defence of Monism against an influential conceivability argument in favour of Dualism. The argument suggests that the apparent possibility of causal behaviour coming apart from (...) categorical bases is best explained by Dualism. We argue that Monism can explain the apparent possibility as well, if we take metaphysically alien laws — namely, laws whose metaphysical nature is alien to the actual world — into account. (shrink)

ABSTRACT Lewtas [2017] recently articulated an argument claiming that emergent conscious causal powers are impossible. In developing his argument, Lewtas makes several assumptions about emergence, phenomenal consciousness, categorical properties, and causation. We argue that there are plausible alternatives to these assumptions. Thus, the proponent of emergent conscious causal powers can escape Lewtas’s challenge.

When two people need a kidney transplant, but only one kidney is available, we need to decide who gets it. If one of the potential recipients needs the kidney because of their own voluntary behavior, but the other is not at all responsible for needing a kidney, then we need to decide whether this fault should be a consideration in favor of the other patient getting the kidney. While there has been considerable philosophical debate on this issue, there is far (...) less research into the views of the public. To explore opinions on these issues, we first asked survey participants to ascribe or deny responsibility for the risky behavior for kidney disease, and for being deprived of a kidney in cases of drinking alcohol, drug abuse, smoking and unhealthy eating when the patient did or did not stop the risky behavior after being diagnosed with kidney disease. Next, we asked participants who should get the kidney when the patient who engaged in risky behavior did or did not know, or have easy access to, the information that the behavior was risky. We found that participants generally ascribed responsibility on the basis of knowledge but allocated the kidney on the basis of access to information. These findings have important implications for moral theories as well as medical policies. (shrink)

Projects that challenge students to practice service leadership for civic improvement can address the aim of developing civic-mindedness in undergraduates. We conducted two qualitative studies. First, we investigated the learning experiences of four teams of undergraduate business students, who undertook semester-long course-embedded service-learning projects in partnership with four Hong Kong-based social enterprises. The students described five modes of civic engagement as project purposes, mentioned applying six types of service leadership practice for civic improvement, and described eight types of developmental outcome (...) within the domain of civic-mindedness. Comparisons suggested that besides relational support through training and guidance, empowering infrastructure, opportunities to exercise autonomy, and opportunities to demonstrate competence, three project-related features that varied between projects were important in fostering civic-mindedness. These were direct contact with grassroots-based beneficiaries; the experience of making a tangible difference; and linking the campus with the wider community. A second qualitative study indicated that course-embedded team projects with these features that were undertaken in mixed teams that included freshman and senior year business students fostered civic-mindedness for both categories of student. BackgroundIn the early stages of the COVID-19 pandemic, many health systems, including those in the UK, developed triage guidelines to manage severe shortages of ventilators. At present, there is an insufficient understanding of how the public views these guidelines, and little evidence on which features of a patient the public believe should and should not be considered in ventilator triage.MethodsTwo surveys were conducted with representative UK samples. In the first survey, 525 participants were asked in an open-ended format to provide (...) features they thought should and should not be considered in allocating ventilators for COVID-19 patients when not enough ventilators are available. In the second survey, 505 participants were presented with 30 features identified from the first study, and were asked if these features should count in favour of a patient with the feature getting a ventilator, count against the patient, or neither. Statistical tests were conducted to determine if a feature was generally considered by participants as morally relevant and whether its mean was non-neutral.ResultsIn Survey 1, the features of a patient most frequently cited as being morally relevant to determining who would receive access to ventilators were age, general health, prospect of recovery, having dependents, and the severity of COVID symptoms. The features most frequently cited as being morally irrelevant to determining who would receive access to ventilators are race, gender, economic status, religion, social status, age, sexual orientation, and career. In Survey 2, the top three features that participants thought should count in favour of receiving a ventilator were pregnancy, having a chance of dying soon, and having waited for a long time. The top three features that participants thought should count against a patient receiving a ventilator were having committed violent crimes in the past, having unnecessarily engaged in activities with a high risk of COVID-19 infection, and a low chance of survival.ConclusionsThe public generally agreed with existing UK guidelines that allocate ventilators according to medical benefits and that aim to avoid discrimination based on demographic features such as race and gender. However, many participants expressed potentially non-utilitarian concerns, such as inclining to deprioritise ventilator allocation to those who had a criminal history or who contracted the virus by needlessly engaging in high-risk activities. Over recent years, the issue of corruption in the public construction sector has attracted increasing attention from both practitioners and researchers worldwide. However, limited efforts are available for investigating the underlying factors of corruption in this sector. Thus, this study attempted to bridge this knowledge gap by exploring the underlying factors of corruption in the public construction sector of China. To achieve this goal, a total of 14 structured interviews were first carried out, and a questionnaire survey was then administered (...) to 188 professionals in China. Two iterations of multivariate analysis approaches, namely, stepwise multiple regression analysis and partial least squares structural equation modeling were successively utilized to analyze the collected data. In addition, a case study was also conducted to triangulate the findings obtained from the statistical analysis. The results generated from these three research methods achieve the same conclusion: the most influential underlying factor leading to corruption was immorality, followed by opacity, unfairness, procedural violation, and contractual violation. This study has contributed to the body of knowledge by exploring the properties of corruption in the public construction sector. The findings from this study are also valuable to the construction authorities as they can assist in developing more effective anti-corruption strategies. (shrink)

Environmental eco-centrism, the claim that all members of the biosphere are ontologically and axiologically equal, presents a challenge to traditional ethical conceptions of the special status of humanity. Confucian and Kantian ethics approach this topic, and its application to other animals, in different ways: Confucianism employs stories that promote insight into the importance of sincerity and compassion to all animals, including non-human ones; Kant employs abstract reasoning to argue that non-human animals deserve respect because we humans share their basic nature. In this paper we describe a few interrelated issues for validating theories that posit levels of consciousness. First, validating levels of consciousness requires consensus about the ordering of conscious states, which cannot be easily achieved. This problem is particularly severe if we believe conscious states can be irreducibly smeared over time. Second, the relationship between conscious states is probably sometimes intransitive, which means levels of consciousness will not be amenable to a single continuous measure. Finally, even if a multidimensional approach (...) to levels of consciousness is adopted, we argue that there are further problems for its validation. (shrink)

ObjectivesWorking-age cancer patients face barriers to resuming work after treatment completion. Those resuming work contend with reduced productivity arising from persisting residual symptoms. Existing studies of return to work after cancer diagnosis were done predominantly in Western countries. Given that employment and RTW in cancer survivors likely vary regionally due to healthcare provision and social security differences, we documented rates and correlates of RTW, work productivity, and activity impairment among Chinese cancer survivors in Hong Kong at one-year post-treatment.MethodsOf 1,106 cancer (...) patients assessed at six-months post-cancer treatment, 593 previously worked; detailed work status, psychological distress, physical symptom distress, supportive care needs, health-related quality of life, and illness perception were assessed. Six months later, work productivity and activity impairment were assessed. Descriptive analyses examined RTW rate. Fully adjusted regressions determined RTW, work productivity, and activity impairment predictors.ResultsAt baseline, 39% were working, 26% on sick leave, and 35% were unemployed. Compared to patients returning to work, unemployed participants were older, likely manual/service-oriented workers, and had lower family income, chemotherapy, fewer unmet health system and information needs, poorer physical functioning, and negative illness perceptions. Sick leave participants were likely service-oriented workers, who had head and neck cancer, chemotherapy, and poor physical functioning. At FU, baseline depressive symptoms, physical symptom distress, and negative illness perceptions predicted presenteeism and work productivity loss; gynecological cancer, fewer unmet health system and information needs, and greater unmet sexuality needs predicted absenteeism; physical symptom distress, negative illness perception, and poor physical functioning predicted activity impairment.ConclusionCancer survivors who had more physically demanding jobs and poorer physical functioning delayed RTW. Unmanaged physical symptom and psychological distress hindered work productivity. (shrink)

Business ethics and leadership play an increasingly important role for contemporary organizations as employers and employees search for new ways to cope with ongoing changes in organizational environments. Research attention to date has focused upon how to improve process and structural configurations, while there has been scant attention devoted to an examination of the ethical and leadership perspective. This article breaks new ground by exploring the applicability of the Rule of St. Benedict (RSB) to modern employment relationships. A large body of research links testosterone and cortisol to male-male competition. Yet, little work has explored acute steroid hormone responses to coalitional, physical competition during middle childhood. Here, we investigate testosterone, dehydroepiandrosterone, androstenedione, and cortisol release among ethnically Chinese boys in Hong Kong, aged 8–11 years, during a soccer match and an intrasquad soccer scrimmage, with 63 participants competing in both treatments. The soccer match and intrasquad soccer scrimmage represented out-group and in-group treatments, respectively. Results revealed that testosterone showed (...) no measurable change. DHEA increased during both treatments in the majority of participants and the degree of change had no relation to independent variables or covariate measures. Most boys experienced androstenedione increases during match play, but no significant differences during the intrasquad soccer scrimmage competitions. The magnitude of change differed significantly between treatments and was positively associated with age. These latter findings suggest boys’ androstenedione responses may be sensitive to competitor type. For most subjects, cortisol significantly increased during match play, decreased during the intrasquad soccer scrimmage, and differed significantly between treatments, suggesting each treatment promoted a different psychological state among competitors. Cortisol/DHEA molar ratio decreased during the intrasquad scrimmage, suggestive of a more relaxed mental state. These data shed new light on potential proximate mechanisms associated with coalitional competition among prepubescent boys, with relevance to adrenarche and life history theory. (shrink)

This book is a collection of articles on different aspects of university education in China since the late nineteenth century, addressing how far the ideal of modern university education, which has gradually been developed in the West since the age of European Enlightenment, was adopted or transformed by Chinese universities.

This study examines the relationship between procedural justice and employee job insecurity, and the boundary conditions of this relationship. Drawing upon uncertainty management theory and ethical leadership research, we hypothesized that procedural justice is negatively related to job insecurity, and that this relationship is moderated by ethical leadership. We further predicted that the moderating relationship would be more pronounced among employees with a low power distance orientation. We tested our hypotheses using a sample of 381 workers in Macau and Southern (...) China. The results support all of our hypotheses. This chapter develops and defends an account of reason: to reason is to scrutinize one’s attitudes by consulting the perspectives of other persons. The principal attraction of this account is its ability to vindicate the unique of authority of reason. The chapter argues that this conception entails that reasoning is a robustly social endeavor—that it is, in the first instance, something we do with other people. It is further argued that such social endeavors presuppose mutual respect on the part of (...) those participating in them. The account therefore yields a form of Kantian constructivism: we have an unconditional duty of respect for persons because such a duty is implicit in the very nature of reasoning. -/- . (shrink)

My aesthetic judgements seem to make claims on you. While some popular accounts of aesthetic normativity say that the force of these claims is third-personal, I argue that it is actually second-personal. This point may sound like a bland technicality, but it points to a novel idea about what aesthetic judgements ultimately are and what they do. It suggests, in particular, that aesthetic judgements are motions in the collective legislation of the nature of aesthetic activity. This conception is recommended by (...) its ability to explain some important but otherwise recondite features of aesthetic practice and, more importantly, by allowing us to ground the normativity of aesthetic judgement in the familiar normativity of practice. It also offers a more systematic way of understanding the rivalry between the ideals of aesthetic universality and diversity. (shrink)

Many people find comparisons of the value of persons distasteful, even immoral. But what can be said in support of the claim that persons have incomparable worth? This chapter considers an argument purporting to show that the value of persons is incomparable because it is so great—because it is infinite. The argument rests on two claims: that the value of our capacity for valuing must equal or exceed the value of things valued and that our capacity for valuing is unbounded (...) in a very strong sense. After laying out this argument, I consider its implications for how we should regard each other. In particular, I suggest that it complicates efforts to understand morality as a system of principles. Instead, I propose that an aesthetic attitude, not unlike our experience of the sublime, is an apt response to humanity’s infinite value. -/- . (shrink)

This paper starts by investigating Ackermann's interpretation of finite set theory in the natural numbers. We give a formal version of this interpretation from Peano arithmetic (PA) to Zermelo-Fraenkel set theory with the infinity axiom negated (ZF−inf) and provide an inverse interpretation going the other way. In particular, we emphasize the precise axiomatization of our set theory that is required and point out the necessity of the axiom of transitive containment or (equivalently) the axiom scheme of ∈-induction. This clarifies the (...) nature of the equivalence of PA and ZF−inf and corrects some errors in the literature. We also survey the restrictions of the Ackermann interpretation and its inverse to subsystems of PA and ZF−inf, where full induction, replacement, or separation is not assumed. The paper concludes with a discussion on the problems one faces when the totality of exponentiation fails, or when the existence of unordered pairs or power sets is not guaranteed. (shrink)

The young Hegel was entranced by the notion of intellectual intuition, and this notion continues to entrance many of Hegel’ commentators. I argue that Kant provided three distinct conceptions of an intuitive intellect, that none of these involve aconceptual intuitionism, and that they differ markedly from Fichte’s and Schelling’s conceptions of intellectual intuition. I further argue that by 1804 Hegel recognized that appealing to an aconceptual model, or to Schelling’s model, or to his own early model of intellectual intuition generates (...) inevitable and insoluble problems of question-begging. By incorporating several important points from Kant’s Transcendental Ideal into his reinterpretation of Kant’s Transcendental Deduction and Refutation of Idealism, Hegel’s mature discursive and conceptual account of ‘absolute knowing’ performs some of the functions Kant assigned to the intuitive intellect, though without invoking any such intuitive intellect. Schiller says that “it is only through beauty that man makes his way to freedom.” Here I attempt to defend a claim in the same spirit as Schiller’s but by different means. My thesis is that a person’s autonomous agency depends on their adopting an aesthetic identity. To act, we need to don contingent features of agency, things that structure our practical thought and explain what we do in very general terms but are neither universal nor necessary features of agency (...) as such. Without these things, the question of what to do for any individual would be underdetermined. The problem is that adopting such a contingent form of agency amounts to a restriction on what we can do, and so it is a prima facie threat to our autonomy. I will argue that one way, and indeed the only way, of meeting this challenge lies in aesthetic experience. Granting our capacity for aesthetic pleasure the authority to determine the particularities of our agency is compatible with autonomy because doing so means identifying with one’s capacity for pleasure in free and creative activity. Doing this allows us to be both particular sorts of agents and creatures regulated by the universalizing demands of reason. (shrink)
